1. Agreement to Terms
By accessing or using VELA AI's services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, do not use our services. These terms constitute a legally binding agreement between you and VELA AI LLC, a Texas limited liability company.
2. Description of Service
VELA AI provides an AI-powered phone receptionist service that answers inbound calls on behalf of home service businesses, books appointments, and sends SMS confirmations. The service is provided on a subscription basis and is intended for use by legitimate home service businesses including HVAC, plumbing, electrical, appliance repair, and similar trades.
3. Subscriptions and Billing
- Subscriptions are billed monthly in advance.
- A 14-day free trial is offered to new customers. No credit card is required to start the trial.
- After the trial period, your selected plan will be billed automatically unless you cancel.
- All fees are non-refundable except as required by law or as stated in our refund policy.
- We reserve the right to change pricing with 30 days' notice.
- Payments are processed securely through Stripe.
4. Cancellation
You may cancel your subscription at any time by contacting us at [email protected]. Cancellation takes effect at the end of your current billing period. You will continue to have access to the service through the end of the period you have paid for.
5. Your Responsibilities
By using VELA, you agree to:
- Use the service only for lawful business purposes
- Comply with all applicable federal, state, and local laws, including telemarketing and call recording laws
- Notify your customers that calls may be handled by an AI system, as required by applicable law
- Obtain any necessary consents from your customers for call recording or AI processing
- Not use the service to harass, defraud, or deceive callers
- Keep your account credentials secure and not share them with unauthorized parties
6. AI Limitations and Accuracy
VELA's AI receptionist is designed to handle common booking scenarios but may not handle every situation perfectly. You acknowledge that AI systems can make errors and that VELA AI LLC is not liable for any missed bookings, incorrect information, or other errors made by the AI system. You are responsible for reviewing bookings and following up with customers as needed.
7. Limitation of Liability
To the maximum extent permitted by law, VELA AI LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost revenue, or lost business opportunities, arising from your use of or inability to use the service. Our total liability to you for any claim arising from these terms or the service shall not exceed the amount you paid us in the three months preceding the claim.
8. Disclaimer of Warranties
The service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, error-free, or completely secure. We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
9. Governing Law
These Terms of Service are governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising from these terms shall be resolved in the courts of Travis County, Texas.
10. Changes to Terms
We may update these Terms of Service at any time. We will notify you of material changes by email or by posting a notice on our website. Continued use of the service after changes take effect constitutes acceptance of the updated terms.
